In consideration of Membership Fee and being permitted to compete, officiate, observe, work for, or participate in any way in Luminsea Races or being permitted to enter for any purpose any restricted area (defined as any area requiring special authorization, credentials, or permission to enter or any area to which admission by the general public is restricted or prohibited), Member agrees:
Membership does not guarantee access into the hot pits. Access into hot pits requires a signed waiver at Luminsea Registration. Access for non-crew members to hot pits is at the discretion of Luminsea Officials and will not exceed maximum capacity requirement, per insurance regulations. Any person who operates or in any way assists in the operation of a race boat, truck, or support equipment, whether as a driver, throttleman, navigator or active crew member, while testing or in competition, must be a member in good standing with Luminsea Races in addition to any person participating as an active crew (owner, driver, riding or non-riding crew member, active pit crew, tow vehicle driver, mechanics, etc).
I acknowledge that my email address attached to this request and verification provided on-site with a Luminsea Races registration official is correct. I agree that I am 18 YEARS OF AGE OR OLDER at the time of Membership purchase. A valid government issued photo identification (“ID”) WILL be required to be presented at Luminsea Races Event(s) or other points of check-in in order to gain entry into the venue.
I understand that while participating in events sanctioned by Luminsea Races, and its assignees may use my name, picture, pictures taken of myself, of my boat, or any team assets, in any way, medium or material for promoting, advertising, recording or reporting any Luminsea Races sanctioned event before, during and after such event and do hereby relinquish all rights hereto for these purposes.
In consideration of their promotional efforts on behalf of the sport, I hereby assign all commercial communication and broadcast rights to Luminsea Races and do declare them as my lawful agents and representatives regarding such rights.
I hereby agree to assume all responsibility and liability for all acts or activities of myself, my drivers, assistants and crew for any and all damages or injury that may be caused by any or all of us or by our boat, motor, properties or possessions in any way growing out of or resulting from the operation of my Luminsea Races registered boat racing equipment and/or as a result of our participating in an Luminsea Races regatta or special event during the event sanctioning period.
I hereby release, waive, discharge and covenants not to sue the promoter, participants, racing associations, sanctioning organizations or any subdivision thereof, officials, boat owners, drivers, crews, rescue personnel, any persons in any restricted area, promoters, sponsors, advertisers, owners and lessees of premises used to conduct Luminsea Races’ Event(s), premises and event inspectors, surveyors, underwriters, consultants, and other who give recommendations, directions, or instructions or engage in risk evaluation or loss control activities regarding the premises or Event(s) and each of them, their directors, officers, agents, and employees, all for the purposes herein referred to as “Releasees” FROM ALL LIABILITY TO THE UNDERSIGNED, his personal representatives, assigns, heirs, and next of kin FOR ANY AND ALL LOSS OR DAMAGE, AND ANY CLAIM OR DEMANDS THEREFORE ON ACCOUNT OF INJURY TO THE UNDERSIGNED’S PERSON OR PROPERTY OR RESULTING IN DEATH OF THE UNDERSIGNED ARISING OUT OF OR RELATED TO THE EVENT(S) WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE.
I hereby acknowledge that the activities of the Event(s) are very dangerous and involve the risk of serious injury and/or death and/or property damage.
I hereby assume FULL RESPONSIBILITY FOR ANY RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE arising out of any related to the Luminsea Races Event(s) whether caused by NEGLIGENCE OF RELEASEES OR OTHERWISE.
I agree that Luminsea Races may COLLECT, STORE AND USE my personal information for legitimate business purposes, such as, but not limited to, processing payment, fulfilling order, updating order status, shipping and tracking information, responding to customer service requests, and providing updated information. Additionally, as a condition to gain access attend Luminsea Races events, I AFFIRMATIVELY, KNOWINGLY AND VOLUNTARILY CONSENTS to Luminsea Races collecting, storing and otherwise utilizing my ID at the event gates or other points of check-in for legitimate business purposes, including my photo, legal name, date of birth, sex, address of record, telephone number and any other personal information obtained from my ID or from personal information. I agree that Luminsea Races may use the personal information I provide in order to make an account for me on the LifeWallet platform. IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, DO NOT PURCHASE A MEMBERSHIP, ENTER OR ATTEND LUMINSEA RACES’ EVENT.
