Terms and Conditions

I agree that Luminsea and its assigns may use my name, likeness, headshot and photography of my boat, on any medium printed, electronic or digital for promoting, advertising and securing sponsorship. They may use before the event, during and after such event and I do hereby relinquish all rights hereto for these purposes. In addition, I agree and authorize that I have the authority to relinquish all rights for the use in photography of my boat, whereas the names and logos of sponsors and companies may also be present. In consideration of their promotional efforts on behalf of the sport, I hereby assign all commercial communication and broadcast rights to Luminsea and do declare them as my lawful agents and representatives regarding such rights.

No owner, driver, representative or crew member thereof shall hold any other owner, driver, representative or crew member thereof liable for any personal injuries or damage resulting from an accident of racing or maneuvering in the pits occurring in a sanctioned race, except as a result of deliberate collision or other premeditated acts of unsportsmanlike nature.

I acknowledge that my email address attached to this request is correct.

I understand that while participating in the event, Luminsea and its assignees may use my name, picture, pictures taken of myself, of my boat, or any team assets, in any way, medium or material for promoting, advertising, recording or reporting Luminsea during and after such event and do hereby relinquish all rights hereto for these purposes.

I hereby agree to assume all responsibility and liability for all acts or activities of myself, my drivers, assistants and crew for any and all damages or injury that may be caused by any or all of us or by our boat, motor, properties or possessions in any way growing out of or resulting from the operation of my registered boat racing equipment and/or as a result of our participating in an RWO regatta or special event during the event sanctioning period.

In consideration of their promotional efforts on behalf of the sport, I hereby assign all commercial communication and broadcast rights to Luminsea and do declare them as my lawful agents and representatives regarding such rights.

I hereby acknowledge that the activities of the event(s) are very dangerous and involve the risk of serious injury and/or death and/or property damage.

No owner, driver or contestant, associate or representative thereof shall hold any other owner, driver or contestant or representative thereof liable for any personal injuries or damage resulting from an accident of racing occurring in a sanctioned race, except as a result of deliberate collision or other premeditated acts of unsportsmanlike nature.

I acknowledge that:

1. Event Organizer maintains a ZERO-TOLERANCE POLICY regarding illegal or illicit drug use and other unlawful or other wrongful misconduct at and around the Event and Venue. In order to gain entry into the venue, I hereby AFFIRMATIVELY, KNOWINGLY, INTELLIGENTLY AND VOLUNTARILY CONSENTS TO BE SEARCHED by event organizer for the presence of illegal or illicit drugs, weapons and/or other prohibited items prior to or during my presence at the event or venue. I hereby acknowledges and agree that the discovery of any prohibited items shall constitute a material breach of this agreement and a violation of event organizer’s policies and terms and conditions and shall correspondingly give event organizer the RIGHT TO CONFISCATE ANY SUCH PROHIBITED ITEM(S) and/or correspondingly give event organizer the RIGHT TO IMMEDIATELY REVOKE my License to access the venue.

2. I agree that event organizer may COLLECT, STORE AND USE my personal information for legitimate business purposes, such as, but not limited to, processing payment, fulfilling order, updating order status, shipping and tracking information, responding to customer service requests, and providing updated information to r respecting the Event, among others. Additionally, as a condition to gain access to the Venue and attend the event, I AFFIRMATIVELY, KNOWINGLY AND VOLUNTARILY CONSENTS to event organizer collecting, storing and otherwise utilizing my ID at the event gates or other points of check-in for legitimate business purposes, including my photo, legal name, date of birth, sex, address of record, telephone number and any other personal information obtained from my ID or from personal information. I agree that event organizer may use the personal information I provide in order to make an account for me on the LifeWallet platform. IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, DO NOT PURCHASE A TICKET, ENTER OR ATTEND THE EVENT OR VENUE AND EXIT THE SITE.

3. I acknowledge and agree that the event is intended for mature audiences and the event has an age requirement of 18 years of age. As a condition to gain access to the venue and attend the event, I agree that I am, or will be, 18 YEARS OF AGE OR OLDER on the earliest event date listed on the front of the Ticket. A valid government issued photo identification (“ID”) WILL be required to be presented at the event or other points of check-in in order to gain entry into the venue.

4. I acknowledge that all tickets are final sale and cannot be exchanged or refunded.

5. I acknowledge that the event may be recorded (any content captured at or in connection with the event, the “Event Content”). By attending this event, I consent to being photographed, filmed, and/or otherwise recorded, and to any use, by Ruiz Production Group and each of their respective successors, assigns, affiliates, employees, agents, representatives, vendors, and licensees (the “Event Parties”) of my likeness, voice, and name in connection with the Event Parties use or exploitation of the Event Content, in any and all manger and media, in perpetuity.

I, on my own behalf, and on behalf of my heirs, assigns, executors and administrators, hereby unconditionally release, waive and forever discharge the Event Parties from any and all actions, liabilities, damages, losses, costs, expenses, claims or demands, whether known or unknown, foreseen or unseen, of any kind or nature, arising directly or indirectly in connection with my participation in the Event. This release shall apply to any loss of or image to my personal property, and to any personal injury (including death) that I suffer, including, without limitation, any loss, damage or injury sustained or allegedly sustained by me due to the negligent acts or omissions of the Event Parties.
